ELIGIBILITY
FriendsArk services are only to be used by members registered with FriendsArk and are within the rules set for registration. Users must be 15 years of age or over and have consented to the terms and conditions set within this document.
FRIENDSARK TERM AND TERMINATION
This Agreement will remain in full force and effect as long as you use the FriendsArk Service Web site and/or are a Member. You may cancel your membership account at any time, for any reason via the Cancel My Account page or by following the instructions on the “Help” page. FriendsArk may terminate your membership or deactivate your account, block your email or IP address upon any violation or alleged violation of this Agreement without notice and remove all Member content from FriendsArk service.
MEMBER ACCOUNT
Once you have decided to sign up with FriendsArk to become a member with us, you will be required to create a user name and a password for your Members Account. By becoming a Member it will become your sole responsibility for ensuring confidentially of your own password (to ensure that your password remains confidential). It is forbidden to use the ‘Members Account’, ‘User Name’, ‘passwords’ and ‘Members Profile’ that do not belong to you and are the details of other members. It will be your duty to notify us of any suspicion or actual intrusion into your Member Account or Member profile either through using your password or by other means.
ACCOUNT PROFILE
Your profile should stay within what would be considered by the FriendsArk administration as suitable to be posted or up loaded or attached to your account such as pictures, messages or recorded videos. Any materials that are of an explicit nature i.e. nudity, or having sexual content or violence or abusive language will be taken off without your permission, and you may as consequently be temporarily or permanently suspended from using your account. You are required to use the services provided to you by FriendsArk responsibly and maturely so as to not offend or cause any distress to anyone else. Materials of a racial or prejudicial nature will be looked into with care by FriendsArk staff to assess whether the materials are suitable to be posted on the viewing pages and similar actions will be taken if intentionally any insults were made.
• FriendsArk will not be responsible for any offensive material posted by any individual using our service.
DISPUTES OF ACCOUNT HOLDERS
FriendsArk will not take any responsibility in settling disputes between your self and other online users. Any member who finds materials that are disturbing to him/ her will be able to contact the Friends Ark administration for further assistance. They may also wave a ‘concern flag’ on the actual website which usually goes directly to members of staff who will monitor pages and accounts that are violating the terms of use.
THIRD PARTY
FriendsArk are not responsible for any third party content or advertising or promotions. Members will at times be given materials promotions from other organisations and businesses, their content will not be monitored by FriendsArk and therefore FriendsArk would advise all account holders to be cautious before signing up to any promotion or adverts. FriendsArk has no agreement with third party organisations and as such cannot interfere with any contracts made between yourself and the third party organisations or businesses.
LIBRATE
To the degree allowable under related legislations, the users of the FriendsArk website do, hereby release and liberate FriendsArk from any legal responsibility connected to:
• The use of FriendsArk website.
• Any contract they may sign up with third party companies, organisations who are using FriendsArk services.
• Breaking of any Copyright policies/ rules already in place such as (but not limited to) the use videos, music, songs or web blogs or others.
Apart from in authority where such necessities are limited, in no occasion will FriendsArk or any, associates partners (under agreement), such as executives or representative, take the responsibility for any direct or consequential damages including loss of profits and or the loss of information personal or otherwise will not be the responsibility of FriendsArk or any of its representatives or any affiliated organization (through agreement).
GENERAL PRACTICES
The users of FriendsArk recognise that FriendsArk may set up common practices and limits in regards to the use of the service including, the maximum number of days that messages or other uploaded content will be retained by the Service, the maximum number of messages, the size of any message, the disk space that will be allocated on the FriendsArk site, and the number of times and durations for which you may access the Service in a given period of time. You agree that FriendsArk has no liability for the erasure or failure to store any messages and other communications or Content. You acknowledge that FriendsArk retains the right to block, delete, bar any accounts that are not used for such time as may be viewed unsuitable by FriendsArk administration.
EMAIL
From time to time FriendsArk will send you emails related to service provision, promotions, and general advertising. FriendsArk reserves these rights.
WEBBLOG, FORUM, Q&A
• FriendsArk is not responsible for the copying or piracy of any material that belong to other individuals or companies.
• FriendsArk will not be responsible for posting of any materials on the webblog , forum or Q&A that are of a racial prejudicial nature against any racial/ ethnic or religious groups.
• All political point of views and comments posted on the FriendsArk website will be that of the individual posting the comments or political views and not the views of FriendsArk.
MODIFICATION
From time to time FriendsArk may engage in such modification that may be seen as necessary or a part of the general practices. These may include the maximum number of days that messages or other uploaded content will be retained by the Service, and general capacity of any Services made available by FriendsArk the number of messages, the size of any message, the disk space that will be allocated on FriendsArk site and the number of times and durations for which you may access the Service in a given period of time.
ADDITIONAL
This Agreement contains the entire agreement between you and FriendsArk regarding the use of the Services. If any condition of this Agreement is held invalid, the remainder of this Agreement shall maintain in full force and effect (immediately). No party will be deemed as an external beneficiary to this Agreement. Whosoever is not a party to this Agreement has no right to enforce any term of this Agreement. If any condition of this Agreement is found to be invalid or unenforceable, such condition will be changed and interpreted to accomplish the objectives to the greatest extent possible under any applicable law. COPYRIGHT TERMS
FriendsArk reserves all rights. The trademarks, logos and any ‘mottos’ assigned with FriendArk are our property or the property of other third parties. You are not permitted to use these Marks without our prior written consent or the consent of such third party, which may own the Mark(s).
YOU ARE FURTHER required to adhere to the use of protected items legislations protecting, ideas, contents belonging of other individuals or companies from downloading on to the FriendArk site. Friends Ark will not take responsibility for the use of such materials. If such an act is carried out by any FriendsArk account holder such individual will take full responsibility and will be expected to cover any damages, loss of profits, legal costs associated to the action of that particular individual.
